For months, an East Texas military spouse has been battling her homeowners association to keep a swing-set and slide she bought for her four children to enjoy while their father was deployed to Afghanistan.
Candi Fry, of Mineola, wife of Army National Guard Capt. Bill Fry, is being sued by Spring Lake Homeowners Association for installing the swing and slide in violation of covenants and restrictions of the Spring Lake Homeowners Association.
Fry said that the backyard swing-set was the least she could do for her four children, who range in age from 8 to 13, to help get their minds off their father’s deployment to war. The Frys married in early 2011, each bringing young children from their previous marriages.
“The kids had been wanting a swing-set,” Fry said this morning to The Dallas Morning News. She thought the timing was perfect for installing a swing and play-set to help give her children an outlet while their father was off at war.
Before hiring a contractor to put in the swing-set, Fry said she talked to the chairman of her HOA’s architectural review committee and that he verbally gave her consent, telling her, “It’s just a swing-set.”
